Public prosecutor Joana D’Arc Calmon Tristão Guzansky of the Vitória circuit court says that a series of difficulties led to the acquittal, on a 4-3 vote by the jurors, of César Narcizo da Silva. He has been charged with being one of those who carried out the murder of journalist Maria Nilce dos Santos Magalhães. “But the battle is not lost,” the public prosecutor said. An appeal was immediately lodged in December, asking the court to set a new trial, on the basis that the jury’s verdict was “manifestly contrary to the evidence presented.”

According to D’Arc during the December 11 trial the defense lawyers intentionally confused witnesses and the jury by introducing identikit pictures of other possible suspects and then she was allowed little time for rebuttal. “During the preliminary hearing we had only three hours to explain all the dirty tricks that had been played by lawyers Claudio Guerra and Josino Bragança to throw the investigation off-track,” she said. The police had to relaunch their investigation. “In the trial we spent all our time demonstrating that Narcizo, along with José Sasso, shot Maria Nilce,” she added. Sasso died in prison in 1992.

The fact that D’Arc had a heavy cold at the time of the trial also weakened the prosecution’s efforts, she said, because she kept coughing and this caused her to run out of time. She said the defense took advantag4 of her being unwell.

Maria Nilce dos Santos Magalhães was a gossip columnist and editor of Jornal da Cidade in Vitória, Espírito Santo state, Brazil. She was murdered on July 5, 1989. shortly before her death she had threatened in her column to expose information about people said to be involved in drug trafficking and organized crime in the state. Of the six people accused in her murder one has died and two were convicted and have appealed their sentence. One ­– Narcizo – was acquitted. Two others have claimed mental incompetence to stand trial and now must undergo expert medical examination.
